COLLECTIVE BARGAINING AGREEMENT WITH PLUMBERS UNION LOCAL #1

Shown below are brief comments which describes the new provisions for a new Primary "A" Division Collective Bargaining Agreement with Plumbers Local Union #1.

1. DURATION OF AGREEMENT – –
Effective date July 1, 2004 - Termination date June 30, 2007.

2. WAGES – –

Journeymen (Paragraph 7) – –
Total Package of $7.75 (inclusive of $.10 to be added to Organizing Fund) over three (3) years and $.01 for a United Association Joint Labor-Management Industry Educational Lobby Fund.

3. FRINGE BENEFIT FUND (Paragraph 15) – –
Add wording to clarify that Trustees are authorized to add, delete or modify the funds.

4. FRINGE BENEFITS, FAILURE TO PAY (Paragraph 21) – –
Add language authorizing Union to pull men when an employer is "not bonded or under- bonded", upon a 30 day written notice.

5. FRINGE BENEFITS: REIMBURSEMENT FOR LOST TIME FOR FAILURE TO PAY (Paragraph 22) – –
Add language requiring employer to reimburse employee for lost time due to "insufficient bonding".

For each additional 100 employees or fraction thereof an additional $400,000 shall be added for monthly contractors and $200,000 added for weekly contractors. For each additional 100 employees or fraction thereof an additional $600,000 shall be added for monthly contractors and $300,000 added for weekly contractors.

7. PUBLIC WORKS/CUTTING/JOINING (Paragraph 31 & 60) – –
On public works jobs with a contract value of $1,000,000.00 or less, stock pipe lengths 2½ inches in diameter or greater may be cut in half and both ends prepared by manufacturer/supply house.

In addition, SHIFT WORK (Paragraph 31) is amended to expand the list of agencies where shift work is permitted from the Transit Authority and the Department of Transportation to ALL agencies.

Labor and Management also agreed that the threshold of $1,000,000.00 shall be reviewed after one year and may be increased by mutual consent.

9. CONSTRUCTION WATER (Paragraph 44) – DECEMBER 23, 2004 UPDATE – –

One riser or horizontal main, with or without a pump, shall serve sanitary facilities and be available at all times and not require temporary maintenance. This riser shall have no hose cocks. A second riser, horizontal main or branch off of the sanitary facilities riser shall be used for supplying water for construction purposes. The supply of Construction Water shall be maintained by Journeymen Members of Local No. 1 before and after the regular hours of work for concrete pouring, concrete curing and the spraying of fireproofing material as well as for any other purpose when requested by the Agency, Owner or Builder.

The supply of water used for construction purposes (bricklayer) shall not require temporary maintenance when the work is performed within ½ hour before the earliest normal weekday job starting time of any trade or within ½ hour beyond the latest normal weekday job quitting time of any trade, excluding the work/trades listed in the first paragraph. Temporary maintenance is required for all work performed beyond these hours. The supply of water for construction purposes (bricklayer) shall be maintained by Journeymen Members of Local No. 1 for all work performed on Holidays and/or on weekends. The use of any storage vessel or any other alternate water supply to circumvent the intent of this paragraph shall not be permitted.

The supply of water used for construction purposes shall be controlled by a valve and it shall be locked before and after the regular daily hours of work, on weekends and on Holidays. All Alteration and Rehabilitation Work shall not require maintenance except in cases where there is a complete “gut” of the entire building (excluding incidental piping). The maintenance of water will cease when all temporary fixtures and piping are removed and the permanent system is in use. The Journeyman maintaining the Construction Water shall be a productive Employee, up to the limit that an individual may safely perform.

10. RIGGING, MOVING, HOISTING, ETC. (Paragraph 51) – –
Where permission to use non Local 1 personnel is requested, change whom the Employer must notify from "Business Manager" to "Business Agent".

11. CUTTING, JOINING, FABRICATING (Paragraph 60) – –
If "any fabricating" occurs in an Employer’s shop it must be performed by a journeymen and apprentice. (Present Agreement – – Journeyman and Apprentice only required for "cutting and threading operations")
12. STEWARDS (Paragraphs 64, 67) – –

FOR NEW CONSTRUCTION, COMPLETE GUT JOBS AND ALL ALTERATION WORK – –
WHEN REQUIRED – – Remains as is – When more than four (4) employees.

PHASING DOWN – – When a job phases down, a Steward will not be required when there are less than four (4) employees are on the job.
(Present Agreement – – A Steward is not required when there are less than three (3) employees on the job.)

REMOVAL – – A contractor seeking to remove a Steward must contact the Business Agent who will arrange a meeting within 48 hours. If there is no agreement at the meeting, a first step arbitration between Management-Labor must be arranged within 3 days. If Management-Labor do not agree at the first step arbitration, the Steward will be replaced with a “temporary steward” chosen by the Business Agent from among the men on the job. The replaced Steward shall remain on the job as a regular journeyman subject to the same contractual obligations and protections as any other employee. (Present Agreement – – There is no procedure for replacing an incompetent/non-performing Steward.)

FOR ALTERATION WORK – –

APPOINTMENT – – Remains as is – Appointment is by the Business Agent from among the men on the job.

FOR NEW CONSTRUCTION, COMPLETE GUT JOBS – –

APPOINTMENT – – Stewards can be appointed by the Business Agent from among the men on the job or from the Union. The Employer, for good cause,

may object to the first proposed Steward when coming from the Union. (Present Agreement – – The Business Agent can only appoint from among the men on the job.)

13. HIRING REFERRAL SYSTEM (New) – –
Labor and Management agree to develop a Hiring Referral System by January 2005. Such system will include procedures for former employee recall, transfer of current employees between jobs, self solicitations, special skills requests, Union maintained list of out of work journeymen, etc.

14. Management-Labor agree to meet to consider a "Target Fund" which, if implemented, would be funded entirely within the present agreement.
