Pursuant to the provisions of the grievance procedure between the aforesaid parties, the
undersigned was appointed by the parties to serve as the arbitrator. The undersigned Arbitrator
was called upon to hear and determine a controversy involving Article 11, Paragraph 44,
Construction Water.

Accordingly a hearing was held on 6/8/05, at the office of Local 1, located at 158-29
George Meany Blvd., Howard Beach, New York.

ISSUE

"What is the meaning and intent of Article 11, Paragraph 44, Construction Water, of the parties
collective bargaining agreement regarding application to the MTA bus depot, Central
Maintenance Facility, Maspeth Queens, New York (Contract No. 40418)?"

Upon hearing testimony and evidence from the parties present at the scheduled arbitration
hearing regarding the aforesaid issue, the Arbitrator renders an expedited bench decision as
follows.

EXPEDITED BENCH AWARD

Upon the substantial and credible case as a whole, the Arbitrator finds that the language
in Article 11, Paragraph 44, Construction Water, specifically the language "concrete pouring"
and "concrete curing" is understood to mean to the parties for all concrete operations (e.g. all
times when the masons are on the job relative to pouring concrete), as having been the long
standing past practice in the plumbing industry.

The Arbitrator shall retain jurisdiction for enforcement of this Award.
